MLS of Choice FAQs

All spring, you've been hearing from us about MLS of Choice. Now that it's less than a week away, we've been getting some questions from members 

What does the rule say?

Currently, MLSs may assess fees to participating brokers based on the number of agents in their office, whether or not those agents want to join their broker’s MLS. This can include fines to the broker for agents who let their MLS membership lapse. Starting July 1, MLSs may only assess fees based on the number of agents participating in the MLS, so long as non-participating agents are a member of at least one MLS.


Where can I see a copy of the rule?

The full text of the rule is available on the National Association of REALTORs website, under Changes to MLS Policy Statements 7.42 and 7.43 - "MLS of Choice"

When does MLS of Choice go into effect?
July 1st

Am I being forced to change MLSs?

Absolutely not! All this change means is agents have more freedom. Another MLS may give you more value than your current MLS; MLS of Choice lets you shop around to find the best fit for you.

Do I need to leave my local MLS?

You do not need to leave your local MLS, even if you decide to join a different Multiple Listing Service under MLS of Choice.

How does this affect me?

Agents can now satisfy the MLS requirement and join the MLS that gives them the best value, without the fear of their broker being penalized by their local MLS.

Brokers can recruit agents outside of their primary service area agents can join any or all MLSs you allow, without you being fined or penalized.

How will I access properties outside my MLS? 

Under Board of Choice, if you are a REALTOR, you can purchase services like eKeys from local boards you are not a member of. For non-REALTORs, listing agents can give you one-time access via the Supra app, use a more universal lockbox, or meet you at the property.

What is the cost to the agent or broker?

MLS of  Choice is a NAR ruling, not a product. It goes into effect for all REALTORs on July 1st. 

NY State MLS is a statewide MLS. Our membership fees are just $35 per month or $320 per year, with discounts when a whole office with 4+ agents signs up together. You can learn more about us here.
